Re: Gardens HOA v. Vivcom Construction

Dear Board Members and Mr. Rutherford:

We have been receiving calls from real estate agents requesting a Disclosure Letter regarding the referenced matter. You may distribute this to the Members. We will post it on our Web site and assign a password that can be accessed by Association members needing to download this area.

This lawsuit arose from the Association's claim that a contractor, Vivcom, had incorrectly built a staircase at the complex. Repair costs are estimated to cost $15,000 to $20,000.

The Association has obtained a judgment in its favor against the contractor. However, the contractor is insolvent, and its insurer is currently being liquidated by a State Insurance Commissioner. The Association will be submitting a claim in the insurer's liquidation proceeding at the proper time, and will obtain as much money as possible, once the amount of the insurer's assets and liabilities has been determined. In the mean time, the Association may wish to consider utilizing other funds to make any repairs to the stairwell that are deemed necessary by the Board.
